ZNLWVA leader’s bail ruling postponed

The State is opposing bail on the grounds that Mahiya’s release might present a danger to him and affect public security safety and order.
They further argued the 61- year- old’s release might result in clashes between the accused person and security forces and this may undermine the security of the country.
But Zimbabwe Lawyers for Human Rights (ZLHR) lawyers Harrison Nkomo and Andrew Makoni who are representing the war veteran’s leader argue that their client be released on bail in accordance with Section 50(1)(d) of the Constitution as there are no congent reasons accompanied by sufficient evidence to support that assertion.
This comes after lawyers argued that the matter should not proceed as the prosecutor had failed to produce a certificate of prosecution signed by the Prosecutor General according to Section 34 of the Constitution. Magistrate Chikwekwe has since ordered the State to obtained a signed certificate by Monday 1 August 2016.
